MEXICO: Periodista oaxaqueño herido por disparos

Nueva York, 13 de junio del 2007 - El Comité para la Protección de los
Periodistas (CPJ, por sus siglas en inglés) condena el ataque a balazos
contra un periodista mexicano que había recibido amenazas de muerte
vinculadas a su investigación del asesinato el año pasado de un periodista
estadounidense durante violentas manifestaciones callejeras en la ciudad
sureña de Oaxaca.

El martes en la noche un individuo no identificado le disparó dos veces a
Misael Sánchez Sarmiento, periodista del diario Tiempo de Oaxaca, frente a
su casa en las afueras de la ciudad, 323 millas (520 kilómetros) al sureste
de Ciudad de México, el director del periódico, Wenceslao Añorve, indicó al
CPJ. Sánchez, quien resultó herido en la mandíbula y la pierna izquierda,
se encontraba en condición estable hoy tras una cirugía.

Sánchez cubre la fuente política y está cargo de la unidad de investigación
del diario. Había recibido amenazas de muerte en noviembre del 2006 después
de informar sobre el asesinato el mes anterior del periodista
estadounidense Bradley Will (

un documentalista independiente y reportero para el sitio Web Indymedia.
Will fue asesinado mientras cubría un enfrentamiento entre activistas y
agentes del gobierno en la capital provincial.

Añorve señaló que no sabía cuál había sido el motivo del ataque, pero cree
que está vinculado al trabajo periodístico de Sánchez. La policía local y
la procuraduría de justicia de Oaxaca están investigando el incidente,
añadió.

"Condenamos el ataque contra de Misael Sánchez Sarmiento", declaró Joel
Simon, Director Ejecutivo del CPJ. "Instamos a las autoridades de Oaxaca a
investigar profundamente esta agresión y a enjuiciar a todos los
responsables".

Tiempo es un periódico pro-gubernamental que ha criticado al grupo
antigubernamental de izquierda Asamblea Popular del Pueblo de Oaxaca (APPO)
que se enfrentó el año pasado con las autoridades locales durante un
conflicto que mantuvo a la ciudad paralizada durante meses.

El conflicto comenzó el pasado junio cuando las autoridades locales usaron
gas lacrimógeno para reprimir una manifestación de docentes en huelga. Esta
acción motivó a que activistas de izquierda salieran a las calles para
exigir la destitución del gobernador de Oaxaca, Ulises Ruiz Ortiz. Ambos
partes del conflicto atacaron a los medios de comunicación mientras cubrían
los disturbios. El conflicto alcanzó su punto máximo con el asesinato de
Will en octubre.

en represalia directa por su trabajo, mientras que el CPJ continúa investigando las
circunstancias que rodean otros 12 asesinatos. Además, otros cinco
periodistas han desaparecido desde el 2005, tres de ellos este año.

MEXICO: Oaxaca journalist shot and wounded

New York, June 13, 2007 - The Committee to Protect Journalists condemns the
shooting of a Mexican journalist who had received death threats in
connection with his investigation of the slaying of a U.S. journalist
during violent street protests last fall in the southern city of Oaxaca.

Misael Sánchez Sarmiento, a reporter for the Oaxaca-based daily Tiempo, was
shot twice Tuesday evening by an unidentified assailant outside his home on
the outskirts of Oaxaca, 323 miles (520 kilometers) southeast of Mexico
City, the paper's director, Wenceslao Añorve, told CPJ. Sánchez was wounded
in his jaw and left leg and was in stable condition today after surgery.

Sánchez covered local political news and was in charge of the daily paper's
investigative unit. He had received death threats in November 2006 after
reporting on the killing the previous month of U.S. journalist Bradley
Will, an independent documentary filmmaker and reporter for the Web site

.Will was shot while documenting clashes between activists and government
agents in the provincial capital.

Añorve said he did not know the motive behind the attack, but believes it
is related to Sánchez's journalism. The local police and state attorney's
office are investigating, he said.

"We condemn the shooting attack on Misael Sánchez Sarmiento," said Joel
Simon, CPJ's executive director. "We call on Oaxaca authorities to
thoroughly investigate the attack, find all those responsible and bring
them to justice."

Tiempo is a pro-government paper that has criticized the local
antigovernment group Popular Assembly of the People of Oaxaca (APPO), which
clashed last year with Oaxaca authorities during a months-long conflict
that paralyzed the city.

The conflict began last June when authorities used tear gas to break up a
demonstration by striking teachers. That prompted leftist activists to take
to the streets in a bid to oust Oaxacan Gov. Ulises Ruiz Ortiz. Media
outlets were targeted by both sides in the ensuing unrest, and several
journalists were beaten and harassed while covering the violence. The
conflict peaked with Will's murder in October.

Since 2000, six journalists have been killed in direct reprisal for their
work in Mexico

HIEREN DE BALA A PERIODISTA EN OAXACA
El reportero mexicano Misael Sánchez fue herido hoy de bala por un desconocido que le disparó en varias ocasiones en la ciudad de Oaxaca, informó el jefe de redacción del rotativo Tiempo de Oaxaca, Luis Ramírez.
Un desconocido "disparó en seis ocasiones" contra el periodista del diario Tiempo de Oaxaca y las balas le impactaron en la cara, pierna y cuello, dijo Ramírez.
Sánchez fue trasladado en una ambulancia de la Cruz Roja a la clínica de especialidades, en San Bartolo Coyotepec a unos ocho kilómetros al sur de la ciudad de Oaxaca.
El jefe de redacción detalló que Misael Sánchez salió del periódico y fue atacado cuando llegaba a su casa.
Ramírez dijo desconocer los motivos de la agresión, pues no hay reportes anteriores a este atentado.
El periódico Tiempo de Oaxaca se ha caracterizado por ser crítico con la Asamblea Popular de los Pueblos de Oaxaca (APPO), cuyos integrantes tomaron el año pasado gran parte de la capital oaxaqueña para demandar la renuncia del gobernador de Oaxaca, Ulises Ruiz.

DICTAN FORMAL PRISIÓN A ASESINO DE PERIODISTA
El Juez Cuarto de lo Penal en Acapulco, José Jacobo Gorostieta Pérez, decretó auto de formal prisión, por el delito de homicidio calificado, en contra de Genaro Vázquez Durán, presunto asesino del periodista Amado Ramírez Dillanes, asesinado el pasado seis de abril.
La secretaria de acuerdos del Juzgado, Eleazar Franco Acosta, notificó la formal prisión dictada por el juez de lo penal al presunto homicida, quien permaneció arraigado por casi dos meses, y a quien la semana pasada el Juez Cuarto consignó por su presunta responsabilidad en el homicidio del corresponsal de Televisa.
Entrevistado luego de que se le dictara la formal prisión, Vázquez Durán se dijo inocente y aseguró que el auto de formal prisión dictado minutos antes es únicamente "un simple trámite".
Insistió en su inocencia en el crimen de Ramírez Dillanes y dijo que esperará a que se aclare el caso. "No le tengo miedo a nada. Eso es solamente un trámite para mí. Yo estoy limpio de cualquier cosa. Soy inocente", dijo.
El sábado pasado el representante legal de la familia Ramírez Dillanes, Alberto López Rosas aseguró que el móvil del delito era débil, ya que no se había podido probar nada en contra de Vázquez Durán por lo cual señaló que sería liberado próximamente.
Sin embargo, con la formal prisión que le dictó el Juez de lo penal a Vázquez Durán, pasarán varios meses para que la defensa del inculpado pueda promover un amparo o recabar más pruebas a favor del detenido, antes de que el Juez dicte sentencia.

PUERTO RICO
SECRETARIO DE JUSTICIA FIRMA RESOLUCIÓN QUE DA GARANTÍAS A PERIODISTAS
El secretario de Justicia de Puerto Rico, Roberto Sánchez Ramos, firmó hoy una orden administrativa que establece mayores protecciones para los periodistas locales, el producto de su trabajo y sus fuentes de información.
Según informó Justicia en un comunicado, la orden establece que no procederá la citación de periodistas o la emisión de requerimientos de información, documentos u objetos a la prensa, a menos que circunstancias excepcionales lo hagan necesario.
El secretario destacó "la labor tan importante" que realiza la prensa, pues "es esencial para el buen funcionamiento de nuestro sistema democrático de gobierno".
Sánchez Ramos firmó la orden "para brindarles, tanto a los periodistas y medios, unas protecciones que redundarán en mayor seguridad a la hora de realizar su trabajo".
Señaló que aunque existía una orden administrativa que regulaba la citación a periodistas, la misma no ofrecía protección alguna en cuanto a los requerimientos a la prensa de documentos u objetos.


VENEZUELA
ALREDEDOR DE 700 PERIODISTAS PRESENTARON RECLAMO ANTE FISCALÍA GENERAL
Un grupo de más de 700 periodistas suscribió un documento en el que se pronuncian por la situación de la libertad de expresión en Venezuela y lo llevaron a la Fiscalía General para que velen por el cumplimiento de medidas cautelares, se investiguen y den respuesta a los casos denunciados de agresiones a periodistas y medios.
La periodista Valentina Lares, vocera de los periodistas explicó que desde hace dos semanas un grupo de comunicadores convocó a otro grupo de colegas para publicar un comunicado en respaldo a la libertad de expresión, el derecho a la información y el rescate de los espacios de críticas "que están seriamente amenazados actualmente, luego del cierre de Radio Caracas Televisión".
Señaló que lo que surgió como un documento de 15 ó 16 periodistas, fue refrendado por 724 profesionales que firmaron y están de acuerdo en "alzar la voz y decir que aquí está pasando algo grave con la libertad de expresión y tenemos que decirlo a las autoridades venezolanas y a los organismos internacionales. Estamos preocupados ante lo que consideramos el cierre a los espacios de critica necesarios en toda democracia".

El periodista Alberto Nuñez Borja, de radio Líder y de HTV Canal 4, en la ciudad de Arequipa, denunció que recibe amenazas del jefe de la Dirección Territorial Policial de la Región Sur, general Bernabé Garavito Berrocal.

En comunicación con la Asociación Nacional de Periodistas del Perú (ANP) Alberto Núñez informó que a las 13 horas del miércoles 13 de junio, cuando cubría información en la plaza principal de Arequipa, fue rodeado por ocho policías motorizados, al mando del teniente Rodríguez.
 
"Me pidieron mis documentos asegurando que recibían ordenes del general Bernabé Garavito Berrocal" , explicó Núñez, quien indicó que tiene grabadas las declaraciones realizadas por el teniente a cargo de la policía motorizada. 

El periodista informó que los hechos se producen tras las denuncias que presenta contra el referido general en los espacios periodísticos en los que labora.
 
"He denunciado actos irregulares por parte de los responsables de la Escuela de Sub Oficiales de Arequipa con respecto a la contaminación del río Chile", afirmó Núñez Borja.
 
Dijo haber interpuesto un habeas corpus contra el general Bernabé Garavito Berrocal, en el Noveno Juzgado Penal de Arequipa.
 
ACCIÓN RECOMENDADA
Se solicita remitir apelaciones al titular del Ministerio del Interior, para que de oficio dispongan a quien corresponda la investigación inmediata del hecho, la individualización de responsabilidades y la sanción que prevea la ley a quienes resulten responsables.

En una conferencia de prensa desarrollada en el auditorio municipal de Rioja el pasado miércoles 6 de junio, el alcalde de la provincia de Rioja, por Nueva Amazonía, Lorenzo Pariacuri Tantarico, amenazó con denunciar penalmente al corresponsal del diario Voces.
 
La presidenta de la Filial Tarapoto de la Asociación Nacional de Periodistas del Perú (ANP), Silvia Quevedo, informó que en dicha conferencia de prensa le preguntaron al alcalde sobre lo publicado por el diario Voces en el que el presidente de la comisión de regantes "El Progreso Rioja", Alex Salazar Chuquipiondo, denuncia presuntos malos manejos económicos y administrativos en el ejercicio 2006.
 
Pariacuri respondió que "consultará legalmente el caso para denunciar penalmente al corresponsal de Voces, y si es posible conversará con el director del diario para ver el asunto".

Se solicita remitir comunicaciones al alcalde de la Municipalidad de Rioja, expresándole nuestro rechazo a este tipo de intimidaciones verbales y solicitando su cese.

Gaza: Armed Palestinian Groups Commit Grave Crimes

Fighters Execute Captives, Attack Hospital, Put Journalists at Serious Risk

(New York, 13 June 2007) - During recent fighting in the Gaza Strip, armed
Palestinian groups have committed serious violations of international
humanitarian law, in some cases amounting to war crimes, Human Rights Watch
said today.

In internal Palestinian fighting over the last three days, both Fatah and
Hamas military forces have summarily executed captives, killed people not
involved in hostilities, and engaged in gun battles with one another inside
and near Palestinian hospitals. On Saturday, armed Palestinians from
Islamic Jihad and the Fatah-affiliated Al-Aqsa Martyrs Brigade used a
vehicle with a "TV" insignia to attack an Israeli military position on the
border with Gaza.

In the June 9 incident, four armed Palestinians drove a white jeep bearing
"TV" insignias to a fence on the Gaza-Israel border and fired at Israeli
soldiers. The Israelis returned fire, killing one Palestinian. Spokesmen
for Islamic Jihad and the Al-Aqsa Martyrs Brigade, an offshoot of Fatah,
claimed responsibility for the attack. An Islamic Jihad spokesperson denied
that Palestinians had put press markings on the jeep used in the June 9
attack, and accused the Israeli military of doing so after the fact.
However, photos taken by the Associated Press as the attack was under way
show the letters "TV" written in red on the front of the jeep.

"Using a vehicle with press markings to carry out a military attack is a
serious violation of the laws of war, and it also puts journalists at
risk," said Whitson.

Customary international humanitarian law provides that journalists not
taking direct part in hostilities in armed conflict zones "shall be
considered as civilians." The deliberate abuse of this protected status in
order to breach the confidence of an adversary in an attempt to kill,
injure or capture them, would amount to an act of perfidy, a serious
violation of international humanitarian law.

The Palestinian Journalists Union on Sunday criticized the use by armed
factions of press insignia in a statement: "The use of vehicles that carry
"Press," "TV" or other signs . . . exposes journalists' lives to danger,
gives the Israeli occupation a pretext to target and kill journalists and

un grupo de simpatizantes del presidente del mismo gobierno, Iván Vásquez,
cuando cubría una protesta organizada en Requena, ciudad al noroeste del
país.

Freyre Pizango fue golpeado cuando intentaba entrevistarse con un grupo de
vendedores del mercado municipal que se negaba a sumarse a la marcha. Según
el periodista, Da Silva hizo el ademán de saludarlo pero lo golpeó en la
cabeza. Luego, los manifestantes lo empujaron al suelo donde lo golpearon.
En el centro de salud local le diagnosticaron la fractura de la muñeca
derecha y hematomas en todo el cuerpo.

Regional government's photographer and demonstrators assault, injure radio
journalist in Loreto

(IPYS/IFEX) - On 5 June 2007, journalist Antonio Freyre Pizango, of Radio
Jabes radio station's programme "Buenos Días Requena", was assaulted by
Loreto's regional government's video camera operator, Félix Da Silva, and a
group of supporters of that same government's president, Iván Vásquez, when
he was covering a protest march organized in Requena, a town in
northeastern Peru.

Freyre Pizango was hit when he tried to interview a group of municipal
market vendors who refused to join the march. According to the journalist,
Da Silva pretended he was about to greet him but instead hit him in the
head. The protesters then pushed him to the ground where they also beat
him. He was diagnosed at the local health center as having a broken wrist
and bruises all over his body.

(WiPC/IFEX) - WiPC welcomes the release of leading dissident writer Nguyen
Vu Binh on 10 June 2007, after serving four years of a seven-year prison on
espionage charges for his critical writings. He was among three leading
dissidents to be granted an amnesty by President Nguyen Minh Triet, two
weeks ahead of his planned visit to the United States. Sustained
international pressure from human rights organisations and US and European
diplomats is thought to have contributed to his early release.

According to PEN's information, Nguyen Vu Binh, who is a leading member of
the Democracy Club for Vietnam, was arrested on 25 September 2002 and
sentenced by the Hanoi People's Court to seven years' imprisonment, to be
followed by three years' house arrest, on charges of espionage in a
three-hour trial on 31 December 2003. Following the proceedings, the
official Vietnam news agency reported that he had been convicted of having
"written and exchanged, with various opportunist elements in the country,
information and materials that distorted the party and state policies." He
was also accused of communicating with "reactionary" organisations abroad.
His sentence was upheld on appeal on 5 May 2004. He was held at Ba Sao
forced labour camp, in Nam Hà province, in very poor conditions and denied
adequate medical care or nutrition. There have been serious concerns for
his health, and PEN has campaigned for his release throughout his time in
prison.

The 39-year-old writer was targeted for the online publication of one of
his critical essays, "Some Thoughts on the China-Vietnam Border Agreement".
Nguyen Vu Binh is a former journalist who worked for 10 years for "Tap Chi
Cong" ("Journal of Communism"), the official publication of the Communist
Party of Vietnam. In January 2001, he left his post to form the independent
Liberal Democratic Party, and is known for his critical writings calling
for political reform.

(WiPC/IFEX) - WiPC protests the Burmese authorities' decision to extend Daw
Aung San Suu Kyi's house arrest for a fourth consecutive year. PEN calls
for the immediate and unconditional release of Suu Kyi and all others
detained in Myanmar in violation of Article 19 of the United Nations
Universal Declaration of Human Rights.

According to PEN's information, the military authorities announced on 27
May 2007 that Suu Kyi's detention order was being renewed for another year
and that she was to remain under house arrest. Security around her
residence was tightened following the announcement, and a gathering of her
supporters planned for 28 May was violently dispersed by police. Aung San
Suu Kyi was taken into "protective custody" following violent clashes
between her supporters and those of the government on 30 May 2003, and has
since been held under renewable one-year detention orders.

Suu Kyi, daughter of Burma's independence hero General Aung San, became
leader of the National League for Democracy (NLD) in September 1988, and in
1991 led the NLD to a landslide election victory which has never been
recognised by the military government. Prior to this she had lived in the
UK for many years, where she raised two sons with her late husband British
academic Michael Aris, who died in March 1999 of cancer. Suu Kyi has spent
a large part of the past 18 years in detention in Rangoon, much of it in
solitary confinement. She was held under de facto house arrest for six
years from July 1989-July 1995, and again from September 2000 until May
2002, when she was released as part of UN-brokered confidential talks
between the State Peace and Development Council (SPDC) and the NLD, which
began in October 2000. She was awarded the Nobel Peace Prize in October
1991. She is the author of many books, including Freedom From Fear (1991),
Letters from Burma (1997), The Voice of Hope (1997).

International PEN protests the detention of writer and opposition leader
Daw Aung San Suu Kyi, who it considers to be detained in violation of
Article 19 of the United Nations Universal Declaration of Human Rights. We
call upon the State Peace and Development Council (SPDC) to show its
commitment to political dialogue in Myanmar by securing the immediate and
unconditional release of Suu Kyi and all others detained in Myanmar for the
peaceful expression of their views.

(RSF/IFEX) - Reporters Without Borders learned on 30 May 2007 that Iraqi
radio and TV presenter Amal Al-Mudarress has emerged from the coma she had
been in since being shot several times in a murder attempt in Baghdad on 29
April, and is expected to recover. After spending several weeks in critical
condition in Yarmouk hospital, where doctors feared internal haemorrhaging,
the family decided to transfer her to a hospital in the Jordanian capital
of Amman, where she underwent an operation. Her doctors say she is now "out
of danger."

(RSF/IFEX) - Reporters sans frontières a appris le 30 mai 2007 qu'Amal
Al-Moudarress, présentatrice populaire de la radio et de la télévision
irakienne, est sortie du coma et qu'elle survivra à ses blessures. La
journaliste a été atteinte de plusieurs balles lors d'une tentative
d'assassinat le 29 avril 2007. Elle a été transportée dans un état grave à
l'hôpital de Yarmouk, où elle a passé plusieurs semaines dans le coma.
Alors que son état empirait et que les médecins redoutaient une hémorragie
interne, sa famille a pris la décision de la transférer à Amman, en
Jordanie, où elle a pu être opérée. Les médecins la déclarent aujourd'hui
"sortie de la zone de danger".

(IPYS/IFEX) - El 9 de junio de 2007, los directivos del diario "Hora Cero",
de Tamaulipas y Nuevo León, al norte del país, denunciaron que ellos y sus
reporteros han sido amenazados tras informar, en mayo y junio, sobre
presuntos actos de corrupción cometidos por Francisco García Cabeza de
Vaca, alcalde de la ciudad de Reynosa, en Tamaulipas. La última ocurrió el
2 de junio, cuando los agresores les anunciaron que había una bomba en la
sede del medio; una revisión de la sede permitió descartar la intimidación.

Tras las publicaciones (sustentadas con testimonios y documentos), el
diario recibió cinco llamadas telefónicas donde amenazaron con agredir al
director general, Heriberto Deándar Robinson, y al jefe editorial, Héctor
Hugo Jiménez.

El 30 de mayo durante un acto público en una calle cercana al diario, el
alcalde criticó la labor del medio e incitó a los pobladores a agredir a
los periodistas.

Según Deándar Robinson, dos de sus reporteros fueron prevenidos por el
personal de seguridad del alcalde para que se cuidaran porque podrían
sufrir represalias por sus publicaciones.

"Hora Cero" directors and reporters threatened after publishing allegations
of Reynosa mayor's corruption

(IPYS/IFEX) - On 9 June 2007, the directors of the newspaper "Hora Cero",
from Tamaulipas and Nuevo León, in northern Mexico, reported that they and
their reporters have been threatened after publishing information in May
and June about alleged acts of corruption by Francisco García Cabeza de
Vaca, mayor of the city of Reynosa, in Tamaulipas state. The last incident
took place on 2 June, when those making the threats said that there was a
bomb at the newspaper's headquarters, which turned out not to be true.

After the publishing of the articles, containing allegations which are
backed by testimony from several witnesses as well as documentation, the
newspaper received five telephone calls in which executive director
Heriberto Deándar Robinson and general editor Héctor Hugo Jiménez were
threatened with assault.

On 30 May, Mayor García Cabeza de Vaca criticized the paper's work during a
public ceremony on a street near the newspaper, and he incited the public
to assault the journalists.

According to Deándar Robinson, two of the reporters were warned to be
careful by the mayor's security personnel because they could suffer from
reprisals for their articles.

- asking them to ensure that those responsible for the threats are
identified and that the newspaper's directors and reporters are protected

(MFWA/IFEX) - Le 4 juin 2007, Ch'bih Ould Cheikh Malainnie, président du
Front Populaire, un parti d'opposition, a retiré les plaintes de
diffamation qu'il a déposé contre trois journalistes de journaux
indépendants basés à Nouakchott.

Les journalistes, Oumar Moctar, directeur de publication du quotidien
"L'Authentique", Tah Ould Ahmed, directeur de publication du quotidien "Al
Vejr", et Mohamed Mahmoud Ould Bakar, directeur de publication du quotidien
"Al Alem", ont été entendus le 28 mai par la police pendant environ une
heure et demie suite à une plainte deposée contre eux par Malainnie.

Plusieurs articles publiés par les journaux ont liés le président du parti
à un scandale de cocaïne récent qui a frappé le pays au début de mai.

Un autre journaliste, Abdel Fettah Ould Ebeydna, directeur de publication
du quotidien arabophone "Al- Aqsa", que l'homme d'affaires avait accusé de
diffamation, a été arrêté et mis en prison pour quatre jours avant qu'il ne
soit remis en liberté sous caution pour que l'enquête puisse être
poursuivie.

Opposition party chairman withdraws complaint against journalists

(MFWA/IFEX) - On 4 June 2007, chairman of the opposition Popular Front
political party, Ch'bih Ould Cheikh Malainnie, withdrew complaints of
defamation he filed against three journalists from privately-owned
Nouakchott-based newspapers.

The journalists, managing editor of the daily newspaper "L'Authentique",
Oumar Moctar, managing editor of the daily "Al Vejr", Tah Ould Ahmed, and
managing editor of the daily "Al Alem", Mohamed Mahmoud Ould Bakar, were on
28 May interrogated by police for about one and a half hours, following a
complaint against them made by Malainnie.

In several articles, the newspapers had linked the party's chairman to a
recent cocaine scandal that hit the country in early May.

Another journalist, Abdel Fettah Ould Ebeydna, managing editor of
"Al-Aqsa", a daily Arabic language newspaper, was accused of defamation by
a businessman and was subsequently arrested and imprisoned for four days
before being granted bail pending further investigations into the matter.

Convicted journalist briefly detained for failure to pay fine, later
released following press union's intervention

(MFWA/IFEX) - Lamin Fatty, a reporter with the banned newspaper "The
Independent", who was convicted of publishing false information, has filed
an appeal at a High Court in Banjul against his conviction.

MFWA sources indicated that Lamin S. Camara, counsel for Fatty, appealed
against the ruling immediately after the judge delivered it on 5 June 2007.

The Kanfing District Magistrate Court, presided over by Buba Jawo,
convicted and fined Fatty, who has been unemployed for more than a year,
50,000 Gambian Dalasi (approx. US$1,850), or a year's imprisonment in
default.

MFWA sources said due to Fatty's inability to pay the fine, he was taken to
Mile Two Central Prison in the outskirts of Banjul and detained for about
three hours. He was released after the Gambia Press Union (GPU) paid the
fine.

GPU President Madi Cessay slammed the court's ruling. "It is not good for
the country's image. Gambia already ranks second in the league table of
countries with bad press freedom record," he lamented.

Cessay further disclosed that the GPU would soon challenge all repressive
media laws in the country's courts.

Fatty made his first appearance in court on 12 June 2006 after he was
arrested and held incommunicado for more than two months, far in excess of
the 72 hours stipulated in the 1997 Gambian Constitution for citizens to be
detained without trial.

In its 24-26 March 2006 edition, "The Independent" erroneously reported
that Samba Bah, a former functionary of the Gambian government, was among a
number of people arrested by the government in the wake of a purported coup
attempt. Following Bah's denial, the newspaper retracted the story and
apologized to him.

The police soon thereafter raided the offices of "The Independent" and
arrested all staff members, including Cessay and Musa Saidykhan, general
manager and editor-in-chief, respectively. They were subsequently released
without charge. Fatty was arrested by the Gambian police on 10 April 2006
and was illegally detained for 63 days.

On 27 July, Bah could not convince the court that he had good reason to not
institute a civil suit against "The Independent" when he was not satisfied
with the apology.

Defence lawyer Camara pointed out that it was strange that Bah was serving
as a state witness and not as the complainant. Bah, however, replied, "It
could be both. I could have gone to a civil court if I so wished and the
government, too, can take the matter to court."

The case which lasted for 12 months saw several adjournments, prompting
Fatty's lawyer to consistently complain that it was dragging on for too
long.

murder

(RSF/IFEX) - According to an article in the "Folha de São Paulo" daily
newspaper of 8 June 2007, members of the local military police were
involved in the 5 May murder of Luiz Carlos Barbon Filho in Porto Ferreira,
in São Paulo state.

A contributor to the "Jornal do Porto" and "JC Regional" local newspapers,
Barbon accused five local officials and four businessmen of sexual abuse of
teenage girls in an article in 2003.

The Department for General Inquiries (DIG) has been put in charge of the
investigation so that the Porto Ferreira police are not subjected to local
political pressure. A regional military police commander, Marli Rossi Silva
dos Reis, denied knowledge of any "involvement of the military police in
this murder".

(RSF/IFEX) - RSF condena las amenazas de muerte que, comenzando en mayo de
2007, vienen recibiendo en Quito los representantes del canal público
latinoamericano Telesur. La organización constata que esas manifestaciones
hostiles en contra del canal, no son las primeras y pide a las autoridades
ecuatorianas que terminen con ellas rápidamente.

"Las amenazas de muerte y los intentos de sabotaje que afectan a la
división ecuatoriana de Telesur se han producido poco tiempo después de las
maniobras de acoso e intimidación padecidas por Freddy Muñoz, el
corresponsal colombiano del canal. Telesur representa a una importante
corriente de opinión en América Latina, y el oprobio que sufre en algunos
países contraviene el respeto al pluralismo editorial. Pedimos a la
justicia ecuatoriana, encargada del presente caso, que identifique y
condene a los autores de las amenazas", ha declarado RSF.

En una conferencia celebrada el 12 de junio de 2007 en Quito, el presidente
de Telesur, Andrés Izarra, denunció que desde hace un mes "el personal del
canal está sufriendo una campaña de acoso" en la capital ecuatoriana. El
patrón de prensa subrayó que la periodista Helena Rodríguez había recibido
amenazas de muerte en su correo electrónico, procedentes de la dirección
"Muerte a Telesur". "En los mensajes se le acusa de ser una prostituta del
presidente Hugo Chávez", precisó Izarra. Otros periodistas del canal han
recibido el mismo tipo de amenazas, y un vehículo de la emisora ha sido
saboteado.

En diciembre de 2006, los servicios de inteligencia colombianos detuvieron
en el aeropuerto de Bogotá a Freddy Muñoz, el corresponsal colombiano de
Telesur, cuando regresaba de Caracas, donde tiene la sede el canal. Acusado
erróneamente de estar a sueldo de la guerrilla de las Fuerzas Armadas
Revolucionarias de Colombia (FARC) y víctima de un fotomontaje destinado a
acreditar esa tesis, el periodista fue encarcelado, y posteriormente puesto
en libertad, el 9 de enero de 2007. Buscado de nuevo por la justicia, tuvo
que huir tras verse amenazado por paramilitares colombianos (ver las
alertas de IFEX del 19 de febrero, 11 y 3 de enero de 2007, 19 y 7 de
diciembre, y 29 y 21 de noviembre de 2006).

El canal informativo Telesur, creado el 24 de julio de 2005 por iniciativa
del presidente venezolano Hugo Chávez, quiere ser una respuesta a la
influencia de los medios de comunicación norteamericanos en América Latina.
Izarra, periodista y ex Ministro de Comunicación de Hugo Chávez, lo preside
desde 2006. El capital del canal está repartido entre varios Estados:
Venezuela, Argentina, Uruguay, Cuba y más recientemente Bolivia.

Staff of Telesur news channel receive death threats, one of their vehicles

(RSF/IFEX) - RSF has condemned the death threats that have been being made,
since May 2007, against the Quito-based staff of the pan-Latin American
television news channel Telesur. This is not the first time the station,
launched by the Venezuelan government, has been the target of hostility.
RSF calls on the Ecuadorean authorities to act quickly to ensure such
hostilities do not continue.

"The death threats and attempted sabotage of Telesur's Ecuadorean division
come on the heels of attempts to harass and intimidate its Colombian
correspondent, Freddy Muñoz," RSF said.

"Telesur represents an important current of opinion in Latin America and
the way it is being attacked and smeared in some countries violates the
principle of respect for editorial pluralism," the organisation added. "The
threats have already been reported to the Ecuadorean judicial authorities.
We urge them to identify those responsible and bring them to justice."

In a Quito news conference of 12 June 2007, Telesur chairman Andrés Izarra
condemned a "campaign of harassment against the station's staff" in Quito
that began about a month before. He said journalist Helena Rodríguez had
received death threats from a "Death to Telesur" email address. "The
messages accuse her of being (Venezuelan) President Hugo Chávez's
prostitute," he said. Similar threats have been sent to other staff members
and one of the station's vehicles was sabotaged.

Muñoz, Telesur's Colombia correspondent, was arrested at the Bogotá airport
in December 2006 by Colombian intelligence officials as he was returning
from Caracas, where the station has its headquarters. The authorities
accused him of being in the pay of the guerrillas of the Revolutionary
Armed Forces of Colombia (Fuerzas Armadas Revolucionarias de Colombia,
FARC), offered a photomontage supposedly supporting this claim, and
detained Muñoz until 9 January 2007. He subsequently had to flee because
the judicial authorities were looking for him again, and because he was
under threat from Colombia's paramilitaries (see IFEX alerts of 19
February, 11 and 3 January 2007, 19 and 7 December, and 29 and 21 November
2006).

Telesur was launched at President Chávez's initiative on 24 July 2005 as a
counterweight to the influence of the US networks in Latin America. Izarra,
a journalist and former communication minister in the Chávez government,
has been its chairman since last year. The station is jointly financed by
the governments of Venezuela, Argentina, Uruguay, Cuba and, most recently,
Bolivia.

(RSF/IFEX) - Reporters Without Borders has condemned new media censorship
in Yemen, where access to at least two websites has been blocked since the
start of 2007, in one case for three months, and the information ministry
is now censoring the distribution of news to mobile phones by SMS message.

"It is disturbing that the Yemeni government is attacking new technology in
this way," the press freedom organisation said. "It never showed any
open-mindedness towards the opposition media and these new arenas of
expression offered a fresh opportunity for the media. The authorities have
again demonstrated their determination to control news and information that
is critical of them."

The al-Shora website, which regularly posted opposition articles, was
closed on 24 February 2007. It was finally allowed to reopen on 23 May. The
socialist website aleshteraki was similarly closed for a week, from 16 to
23 May. The government was worried by the fact that they were controlled by
opposition parties. It was also concerned about their coverage of the
fighting with the al-Houthi rebels in Saada province.

The information and telecommunications ministry has now banned several
mobile phone news distribution services, including those proposed by the
companies Nass mobile and Bela Qoyod mobile, on the grounds that they were
not subject to sufficient control. The ministry nonetheless said that the
authorities could offer such services.

SMS messages expressing criticism of President Ali Abdullah Saleh's
government had circulated in the weeks prior to the ban. The opposition
parties denied being behind them. On 7 June, the government announced the
start of a debate about a new press law, one concerning new media in
particular.

(RSF/IFEX) - Reporters sans frontières dénonce la censure des nouveaux
médias au Yémen. Au moins deux sites Internet ont été bloqués pendant
plusieurs mois depuis le début de l'année 2007 et le ministère de
l'Information censure désormais la diffusion des SMS informatifs.

"Il est inquiétant que le gouvernement yéménite s'en prenne ainsi aux
nouvelles technologies. Il n'a jamais fait preuve d'ouverture à l'égard des
médias d'opposition et ces nouveaux espaces d'expression étaient une chance
pour la presse. Les autorités ont fait une nouvelle fois la démonstration
de leur volonté de contrôle de l'information la plus critique à leur
égard", a souligné l'organisation.

Le site Internet al-Shora, qui publiait régulièrement des articles
d'opposition, avait été fermé le 24 février 2007. Il a finalement été
autorisé à rouvrir le 23 mai. De la même façon, le site socialiste
aleshteraki a été bloqué pendant une semaine, entre le 16 et le 23 mai. Le
gouvernement s'inquiétait de leur contrôle par des partis d'opposition et
de leur couverture des combats avec les rebelles d'Al-Houti, dans la
province de Saada.

Le ministère de l'Information et des Télécommunications a interdit par
ailleurs plusieurs services de diffusion d'informations par téléphone
mobile, tels que ceux proposés par la compagnie Nass Mobile ou la compagnie
Bela Qoyod mobile. Le prétexte invoqué était que les SMS ne faisaient pas
l'objet d'un contrôle suffisant. Le ministère a précisé néanmoins que les
mêmes services peuvent être offerts, mais par les autorités exclusivement.
Plusieurs messages d'opposition au président Ali Abdullah Saleh avaient
circulé dans les semaines précédant l'interdiction. Les partis d'opposition
ont nié en avoir été à l'origine. Le 7 juin 2007, le gouvernement a annoncé
l'ouverture d'un débat sur une nouvelle loi sur la presse, en particulier
concernant les nouveaux médias.
